MigraineGuard is a wellness and personal tracking app for organizing migraine-related context. By accessing or using MigraineGuard, you agree to these Terms.
Important Health Notice
MigraineGuard is for education, personal tracking, and risk-context review only. It does not provide medical advice, diagnosis, treatment, prevention, cure, emergency care, or guarantees about migraine or headache outcomes. Do not ignore or delay professional medical advice because of the app. If you may be experiencing a medical emergency, call emergency services immediately.
1. Eligibility
You must be at least 13 years old to use MigraineGuard. If you are under the age of majority where you live, you may use the service only with involvement and permission from a parent or legal guardian.
2. Your Use of the Service
You may use MigraineGuard for lawful personal purposes. You agree not to misuse the service, interfere with its operation, attempt unauthorized access, bypass security controls, reverse engineer protected parts of the service, submit malicious code, or use the service to harm others.
3. Accounts and Guest Mode
You may use supported parts of MigraineGuard in guest mode without creating an account. Guest data is intended to stay on the device using browser storage, paid actions are disabled, and guest data may be lost if you clear storage, change browsers, uninstall the app, or leave guest mode. Account features may use authentication and cloud storage providers to sync supported settings and app data across devices.
4. User Content and Health Logs
You choose what to enter. Your logs may include sensitive wellness or health-related information. You grant MigraineGuard the limited permission needed to host, process, display, back up, and transmit your information only to operate and improve the service, comply with law, protect rights and safety, and provide features you request.
5. No Medical or Emergency Use
Risk scores, alerts, weather context, pattern insights, educational content, and generated materials are estimates and organization tools. They may be inaccurate, incomplete, delayed, unavailable, or not relevant to your personal circumstances. MigraineGuard is not designed to diagnose a condition, recommend treatment, determine whether medication is appropriate, replace a clinician, or monitor emergency symptoms.
6. Third-Party Services
MigraineGuard may use third-party services for weather data, authentication, hosting, analytics, email, payment, database, and security functions. Those providers may change, fail, or provide inaccurate data. MigraineGuard is not responsible for third-party service interruptions, third-party terms, or inaccurate third-party information.
7. Paid Features
Some features may require payment or an active subscription. Prices, features, trials, taxes, renewal timing, and availability may change. Payments are processed by third-party payment providers. Refunds are provided only where required by law or by the applicable payment provider rules.
8. Intellectual Property
MigraineGuard, including its design, branding, software, text, templates, generated materials, and visual assets, is owned by its developer or licensors. You receive a limited, revocable, non-exclusive, non-transferable license to use the service according to these Terms.
9. Privacy
Your use of MigraineGuard is also governed by the Privacy Policy and, where applicable, the Consumer Health Data Policy. Those policies explain the categories of information handled, why it is used, when it may be shared, and your choices.
10. Disclaimer of Warranties
The service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. MigraineGuard does not guarantee that risk scores, alerts, weather information, estimates, reports, content, security controls, or service availability will be accurate, complete, uninterrupted, secure, error-free, or suitable for your personal circumstances.
11. Limitation of Liability
To the maximum extent permitted by law, MigraineGuard and its developer will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including health outcomes, personal injury, emotional distress, lost data, lost profits, loss of goodwill, service interruption, or decisions made based on app information. To the maximum extent permitted by law, total liability for any claim will be limited to the greater of the amount you paid MigraineGuard in the 12 months before the event giving rise to the claim or $100.
12. Indemnity
To the extent permitted by law, you agree to defend, indemnify, and hold harmless MigraineGuard and its developer from claims, damages, losses, liabilities, costs, and expenses arising from your misuse of the service, violation of these Terms, unlawful content, or violation of another person's rights.
13. Suspension and Termination
We may suspend or terminate access if we reasonably believe you violated these Terms, created risk for the service or other users, or used the service unlawfully. You may stop using MigraineGuard at any time. Sections that by their nature should survive termination will survive.
14. Governing Law and Disputes
These Terms are governed by applicable United States law and, to the extent not preempted, the laws of the state where the developer is organized or resides, excluding conflict-of-law rules. Courts may refuse to enforce some dispute terms in some jurisdictions, so this section applies only to the extent permitted by law.
15. Changes
We may update these Terms or change, suspend, or discontinue parts of the service. The updated date will show when changes are posted. Continued use after changes are posted means you accept the updated Terms.
